揮杖打傷人 視障者遭判罰金

（中央社記者黃意涵台北19日電）視障者吳姓男子在家中揮動拐杖，打傷丁姓男子。一審認為居於弱勢的吳男無計可施才動手，判處無罪；二審逆轉判他罰金確定。

根據判決書，家住台北市中山區的丁男認為鄰居吳男家中常於凌晨發出聲響，去年9月間偕同里長前往吳男家中查看，吳男認為對方「侵門踏戶」（台語），於是揮動拐杖，擊中丁男。丁男報警處理。

吳男於台北地院審理時說，他因相信里長才開門，但丁男未經同意就進入他家，「我氣他欺負失明的人」，才揮動拐杖想叫丁男出去。

台北地院認為身為視障人士的吳男，無從阻止對方進入家中何處，完全不知道當下發生何事、丁男去了哪裡、做了什麼，堪稱「無計可施」，雖揮杖導致丁男受傷，但無傷害故意，判處無罪。

高院審理認為，丁男是在吳男開門後才進入其家中，並非無故侵入，且吳男的揮杖行為也不符正當防衛，因此改依傷害罪判處罰金新台幣5000元，罰金得易服勞役確定。1020919
