性侵少女　男大生肖想用公益代刑被打槍

中市張姓男大學生（22歲）前年在台中一間百貨公司打工，認識19歲少女，張男有意追求少女，去年2月，張男將少女帶往百貨公司3、4樓樓梯間，質疑少女為何與前男友聯絡，雙方起爭執，並將少女強拉至4樓男廁，脫光少女衣物性侵，一審一強制性交罪判張男3年6月。

張男上訴，稱欠缺兩性交往正確觀念才會醋勁大發，傷害少女，願長期從事公益贖過，並指己獲少女和家人原諒賠償，要求依《刑法》第59條期情可憫減刑，但台中高分院認為張男達成和解，只能以《刑法》第57條在法定刑內做為量刑參考，沒有其情可憫的情形，也沒有辦法以做公益代刑罰，駁回上訴。
