賣海砂屋 判還近6千萬

（中央社記者黃意涵台北17日電）宋姓男子買下台北市某2層樓房屋後發現是海砂屋，解除買賣契約並請求賣方返還價金新台幣5800多萬元，法院判決宋男勝訴。

根據判決書，宋男於民國99年4月間向李姓建設公司老闆買下台北市士林區某建物7、8 樓房屋，不料，交屋後竟發現是海砂屋，他於同年11月間發函李男解除契約後，提起訴訟請求李男返還買賣價金5870萬元。

李男認為，宋男曾親赴現場檢視房屋數次，對房屋現況及屋齡十分了解後，才簽約，沒有理由解除，且他自購入至賣出，其間長達16年，均未見有任何安全上的問題，他也不知道是海砂屋。

法院一審認為，經台北市結構工程工業技師公會鑑定，檢測屋內12處混凝土氯離子濃度，有10處高於國家標準，更有4處幾乎超過國家標準10倍以上，且有裂縫、鋼筋外露、鏽蝕等瑕疵，李男身為建設公司老闆，應比一般人對氯離子濃度含量問題更有知識。

一審判決李男返還買賣價金5870萬元，李男提起上訴及反訴，請求法院若仍判他敗訴，對方也要把房屋恢復原狀，償還房屋殘值。

台灣高等法院二審審理後，駁回李男上訴，但判決宋男須返還房屋殘值110萬多元，李男還可上訴。1021117
