花盆砸死人辯酒醉　檢不信　男起訴

【鄧玉瑩／台中報導】台中市劉姓男子和童姓男子今年5月8日晚間6時許到一間小吃部飲酒，酒後童嫌隔桌馬姓客人說話太大聲，雙方起爭執，童男拿起劉男機車裡電動鑽的鑽頭，馬男拿廚房菜刀雙方欲互砍，經人報警，警員到現場處理，雙方做罷。
 
之後，劉、童2人到超商，見馬男在買香菸，劉對童說：「你被玩了，是俗仔。」致童男起意修理馬男，兩人尾隨馬男到巷弄內，隨即對馬男拳打腳踢，並先後用路邊的大型花盆，輪流砸向馬，致馬顱內出血，送醫不治。

劉男辯稱當時喝醉意識不清，不過童證稱：「他說我是『俗仔』時，意識清醒、說話正常。」檢方依殺人罪將兩人起訴。
