愛滋身分遭洩漏 役男獲5萬國賠

台灣出現第一起，因公務機關疏失，導致役男感染愛滋身份曝光，而判賠的案例，台北有一名愛滋病患者，3年前要申請免役時，區公所竟然將他愛滋病個案通知書，直接交給他母親，因而掀起家庭風暴。他憤而向法院提出國賠，區公所獲判賠償5萬元定讞。

戴著黑色口罩，帽子拉到眼睛都看不到，25歲的小健身為愛滋病患者，一身裝扮刻意隱藏自己的容貌，但是3年前，他的身分卻被大喇喇攤在陽光下。

談起3年前區公所承辦人員的行為，小健認為根本是知法犯法，之前小健因為怕父母傷心，一直隱瞞感染愛滋病的事實，沒想到卻因為公務員的疏失，掀起家庭風暴，小健氣得向法院申請國賠50萬。

今年4月，法院判獲賠5萬元定讞，耗費2年打官司，即使只獲得5萬的賠償，但小健爭取也算是有了成效，政府也因為他的個案，修正規定，未來愛滋役男通知書要用密件處理，而且只能本人親自領取，希望不幸感染愛滋病的役男，能保有百分之百的隱私。
