裁准理由　失黨籍對王金平有急迫危險

【綜合報導】台北地院合議庭認定，遭撤銷黨籍的王金平與國民黨間，對於王金平的黨籍存否，確有爭執，因《公職人員選舉罷免法》規定，全國不分區立委是否喪失其黨籍，與喪失立委資格相關。
 
合議庭指出，王金平遭國民黨撤銷黨籍，如不准定暫時狀態處分，讓王金平仍保有國民黨黨籍，若王金平透過訴訟取回立委資格，將有發生「日後無法執行且回復其立法委員職務」，這一重大且無法彌補的急迫危險。

合議庭認為，准許暫時狀態處分，對於國民黨來說，如果王金平日後爭取到立委資格，國民黨在立院總席次也不受影響，對國民黨來說，並無損害，雖國民黨主張黨譽因王金平關說受影響，但合議庭認為，即便黨譽受損屬實，也屬已發生的非急迫性損害，因此，在權衡王金平與國民黨兩者間因假處分裁准與否的損害後，裁准王金平的假處分聲請。
 
至於王金平是否因此仍保有立委資格與院長寶座，合議庭認為，這並非民事法庭審理範圍，不做認定。
