明年請生理假 不須檢附證明

立法院日前三讀修正通過「性別工作平等法」部分條文，女性受僱者每月可請生理假1日，只要1年不超過3天，就不併入病假計算。勞委會近日再審議通過，未來女性請生理假時，不用再檢附證明文件

勞委會表示，依性別工作平等法規定，女性受僱者因生理日導致工作有困難者，每月可請1天生理假，且雇主不得拒絕；然而請假規則與其他事由相同，必要時雇主可以要求受僱者提出證明文件，過去因為實務上難以客觀認定，導致勞資爭議頻傳。勞委會26日會議決定修正規定，女性受僱者未來在申請生理假時，可以不須檢附相關證明文件。

勞委會指出，倘若雇主拒絕女性員工請生理假需求，可依性平法規定處以新台幣1萬元以上，10萬元以下罰鍰；修正條文發布施行後，雇主若要求受僱者必須提出生理假證明文件才准假，就算違法，民眾可向當地縣、市政府勞工局或社會局申訴。
