毆女友致眼瞎 男判3年半

（中央社記者陳靜萍台中19日電）台中市一名黃姓男子與趙姓女友同居期間，爭吵時因女友提出分手，憤而揮拳重毆女友，導致女友右眼失明，一審被判3年6月。

台中地方法院判決書指出，這名22歲的黃姓男子素行不佳，今年3月底與趙姓女友在豐原的同居住處，因債務問題發生爭吵，趙女提出分手，惹惱了黃男。

黃男一時惱怒，不但用斷腳的椅子丟擲趙女，還以手揮拳毆打趙女，造成趙女的右眼球破裂、鼻撕裂傷、上嘴唇挫傷，經緊急送醫後，趙女的右眼眼球破裂因而失明。

法官審理後認為，黃男與趙女是同居男女朋友，只因細故，竟不顧雙方情誼，揮拳毆擊趙女，且犯後未與趙女達成民事和解，審理時，黃男一再質疑趙女所受傷害的程度，未見有任何關懷慰問的舉措；反觀趙女以德報怨，在庭上稱「沒有要告被告…我要給被告改過機會，我不願被告去關」。

黃男一審時被依家庭暴力防治法之重傷害罪，被判有期徒刑3年6月，全案還可上訴。1021119
